20 States Passed Copper Theft Laws in 2007


Copper theft has become so rampant across the nation that 20 states, including Hawaii, passed new copper theft legislation in 2007. You know it's serious when copper thieves cause the Friday Night Lights to go dark, as reported in The Advertiser's front page story on the cancellation of the Campbell vs. Roosevelt high school football game.


Hawaii's law, HB1246 , makes copper theft a class C felony and requires scrap sellers to disclose where and from whom they obtained the metal. Alabama bans the sale of scrap copper over $100, while Washington makes it a misdemeanor for any scrap dealer to do business with those who have been convicted of theft or illegal drug usage. The 20 states are Alabama, Arizona, Arkansas, Colorado, Connecticut, Georgia, Hawaii, Indiana, Kansas, Kentucky, Minnesota, Nevada, Oklahoma, Oregon, Rhode Island, South Carolina, Texas, Utah, Washington and Virginia. The problem of copper cable theft is so serious in Las Vegas that telecom carrier Embarq Corp, a spin-off of Sprint Nextel, is offering $5000 for information leading to the arrest of anyone trying to steal their copper cables. So far this year, the company has spent $400,000 in Las Vegas repairing severed cable lines.

Senate Introduces Legislation to Combat Copper Theft


Copper theft has been on the rise at an alarming pace in recent years. Given the value copper fetches, buildings and homes have been ravaged, costing owners and landlords thousands of dollars. Copper theft has been devastating on the real estate community, especially in this time of rising foreclosures. Copper pipes and wire are being stripped from vacant homes and buildings on the market, leaving behind extensive damage and costly repairs.

Recently, legislation has been introduced in the Senate taking aim at regulating and licensing second hand dealers who buy copper. Senate Bills 1113, 888, 720, and 1089 contain provisions and requirements of secondhand and junk dealers.
Among the legislative provisions are:
Prohibiting a secondhand or junk dealer license from being issued to someone who did not have an actual business location.

I first announced the problem of my rental homes and homes that I was rehabbing on this blog last year.

Requiring a dealer's records to include the weight, amount, and number of articles purchased or exchanged.

Requiring a dealer to provide his or her records to a law enforcement agency within 24 hours of a request.

Prescribing a criminal penalty for buying or selling stolen construction materials.

Requiring a dealer to make a copy of the driver license or State identification card of a person from whom the dealer purchased or received items, and include the copy in the dealer's weekly report to the police.

Currently, these bills are in the Senate Economic Development and Regulatory Reform committee. The Senate sponsors would like our official support of these bills. The MAR Public Policy committee is scheduled to meet early next month to analyze the legislation.

I first wrote about this problem, construction site management last year. I have had an ongoing problem with my vacant homes being broke into and striped of metal, copper, appliances, wire and other items of value to scrappers as they are called.

Consumers Energy and many sub-contractors for large utilities and local municipalities now employ tracking or GPS units for large spools of copper wire and plumbing fixtures.

They have a GPS unit or similar tracking device embedded into a roll or palette of fixtures so that the police are notified immoderately if equipment is stolen.

This is a huge problem and will only get worse as the economy worsens and the price for these metals continue to rise, as they will because these metals as being shipped to China and other growing countries.
